  Important information about DWI , DUI and DWAI Prosecution and Penalties in New York Leandra's Law Interlock Ignition Device Under Leandra’s Law Anyone convicted of a misdemeanor or felony DWI in New York is required to install an ignition interlock system into any car owned or driven by them. This penalty applies to anyone who was convicted of a DWI in New York, even if it is their first offense. The ignition interlock is a device that detects blood alcohol concentration by measuring the alcohol in a person’s breath. In order to drive a car that is equipped with the interlock, a person must blow into the device to to turn it on, and then continuously blow into the interlock device periodically to keep the vehicle running. If you are convicted of DWI law and you are required to install the ignition interlock in your car, you are not able to drive any car unless an ignition interlock were installed during the period that the court requires the installation of the ignition interlock in your vehicle, or in vehicles you drive. Many courts in New York City, Westchester, Putnam, Dutchess, Rockland and Ulster are requiring instillation of the ignition interlock for six months, to one year or more. The ignition interlock can cost several hundred dollars to install and maintain. It is extremely sensitive, and it may detect as little as .025 BAC. It may detect such a small amount of alcohol, that the consumption of cough medicine may prevent a person from driving a car with the interlock ignition device installed in it.

Traffic infractions can have a serious and significant effect on your driving privileges and insurance rates. The New York State Vehicle & Traffic Law is constantly changing. Recent amendments include the imposition of 3 points for the traffic infraction of driving while using a cell phone without a hands free device, or to text and drive. In 2011, New York State instituted the “Move Over Act”, which requires drivers to reduce their speed and to move over one lane if it can be done safely, when they observe an emergency vehicle pulled over to the side of the road. If you are not able to safely pull over you may have a defense if ticketed under the “Move Over Act” since it is also a traffic infraction to make an unsafe lane. A violation of the “Move Over Act” is a three point infraction. GOVERNOR CUOMO PROPOSES THAT NEW YORK INCREASE PENALTIES FOR TEXTING WHILE DRIVING On May 31, 2013, Governor Andrew Cuomo announced plans to increase the penalties for texting while driving. He proposes that violators face the same penalties on drivers with probationary and junior licenses for texting-while-driving that they presently receive for speeding and reckless driving: 5 points, 60-day suspensions for first convictions and revocations of 60 days (for junior licenses) or 6 months (for probationary licenses) for subsequent convictions within 6 months of the time a license is restored after suspension. NEW YORK STATE POINT ASSESSMENT SYSTEM The point system is one way that the New York Department of Motor Vehicles (DMV) may suspend or revoke a driver license. If you accumulate three convictions for speeding within 18 months your license will be revoked by the New York State DMV. In New York State, 11 points on your driver’s license will result in your driver’s license being suspended. Moreover, if you are assessed 6 or more points on your driver’s license in an 18 month period, you will face a Driver’s Responsibility Assessment, which is a civil penalty imposed by the New York State Department of Motor Vehicles. Failure to pay the assessment will result in your driver’s license, learner’s permit or driving privileges being automatically suspended. The loss of the ability to drive can be life altering and may affect your personal life and your employment.
